Terms of Use

Effective 3 September 2026 · Version 2.0

1. Agreement to these Terms

These Terms of Use ("Terms") are a legally binding agreement between you ("you", "your") and Path2Negotiate ("we", "us", "our"), governing your access to and use of the Path2Negotiate website and training application, including the tactic library, theory, recognition cards, micro-drills, progress screens and related features (together, the "Service").

By creating an account, buying access, redeeming a code, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Cookies Policy, which are incorporated by reference. If you do not agree, do not use the Service.

2. Definitions

3. The Service

Path2Negotiate teaches tactics for everyday business conversations — management, team and peer. It shows you a situation with four plausible answers under a timer, tells you what your answer cost, and then asks you to say the stronger move out loud to a counterpart played by an AI model. It schedules the material to come back until it holds. It runs in your browser; drills need a working microphone, or you can type instead.

The Service is provided for practice, training and educational purposes. It is a training aid, not a substitute for professional advice, legal, HR or otherwise. See §12 and §13.

We are actively developing the Service. Features, content, session mechanics and limits may change, and some features may be offered as early access and may be modified or discontinued. We will not materially reduce what an entitlement you have already bought gives you without reasonable notice.

4. Eligibility

You must be at least 18 years old to use the Service, and at least 18 (or the age of majority where you live) to buy access or otherwise form a binding contract. The Service is not intended for children.

If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms, and "you" includes that organisation.

5. Accounts and security

Beyond the public demo (§8) you need an Account. There are no passwords: you sign in with an email magic link, or with LinkedIn or GitHub. Your Account is therefore only as secure as that mailbox or that provider account — anyone who reaches them reaches your Account, so keep them secure. You agree to provide accurate information, you are responsible for all activity under your Account, and you may not share it or let others use it. Notify us promptly at info@gestoa.com if you suspect unauthorised use.

6. The microphone, and how drill data is handled

A micro-drill can be answered by speaking or by typing. If you speak, the Service needs access to your microphone. Consistent with our Privacy Policy:

You are responsible for your surroundings and for what you choose to say. Do not include another person's confidential or personal information in a drill answer.

7. Free access, case sets and usage limits

You can run one full loop free — a set number of recognition cards and one micro-drill, stated in the app, with no payment card required. Beyond that you reach the wall, where you can buy access to a case set or redeem a promotional code.

Access to a case set is a one-off purchase, not a subscription: there is nothing recurring and nothing to cancel. A purchase, or a redeemed code, grants an entitlement to that case set for as long as we run it — we do not put a clock on an entitlement once it is granted. If we retire a case set within twelve months of your purchase, we will give reasonable notice and either replace it or refund it.

Each drill is subject to limits described in the app, including a maximum length for the drill and for each spoken answer.

8. The public demo

The card on our home page can be answered without an Account, and it sits outside everything else in these Terms. Demo cards are separate material: they never appear in a scored session, and you can replay them as often as you like. A demo answer is recorded anonymously — no account, no identifier — is never linked to an Account you open later, and neither spends your free allowance nor counts toward your progress. §14 does not apply to it.

9. Billing, taxes and your right of withdrawal

9.1 Payment

Payments are processed by our payment provider, Stripe. By buying, you authorise us, through Stripe, to charge your payment method for the case set you select. You give your card details to Stripe, not to us — we never receive or store your card number, and Stripe handles the payment under its own terms and privacy notice and may run its own fraud checks. A purchase is complete, and these Terms become a contract to supply that case set, when Stripe confirms the payment and we grant the entitlement. If a payment fails or is later reversed, we may withhold or withdraw the access it paid for.

9.2 Prices and taxes

Prices are those shown at the wall or at checkout at the time of purchase. For Consumers in the EU, prices are shown inclusive of applicable VAT where required; for other customers, applicable taxes may be added. You are responsible for any taxes we do not collect. The total is shown to you before you confirm.

9.3 No renewals, and price changes

Case sets are one-off purchases and do not renew automatically — you buy another case set when you want more material. Prices may change over time, but a change never affects a purchase already made.

9.4 Promotional codes

A promotional code grants or discounts access to a case set without a separate purchase. A code may carry a redemption cap and an expiry and stops working when either is reached; those limits belong to the code, not to the access it produces, so an entitlement already redeemed is unaffected. Codes have no cash value, cannot be exchanged for money, are for the use of the person we issue them to, and may be withdrawn at any time before redemption. Access granted by a code lasts as long as access bought with money.

9.5 Stopping, and closing your Account

Because there is no subscription, there is nothing to cancel — you can simply stop. You may delete your Account at any time from Settings or by writing to us. Deleting your Account ends your access and does not, by itself, entitle you to a refund, except as required by law or under §9.6–9.7.

9.6 Consumer right of withdrawal (EU/EEA/UK)

If you are a Consumer you normally have 14 days from entering into the contract to withdraw without giving a reason. Because a case set is digital and delivered immediately, when you ask us to grant access during that period you expressly request immediate performance and acknowledge that you lose your right of withdrawal once access has been granted. If you would rather keep the right, do not confirm that request: wait out the 14 days and we will grant access afterwards. To withdraw, write to info@gestoa.com. Where a valid withdrawal applies, we refund the amounts due without undue delay.

9.7 Refunds

Except for the withdrawal right in §9.6 and any non-waivable statutory rights, payments are generally non-refundable. If what you bought is materially broken and we cannot put it right in reasonable time, write to us and we will repair, replace or refund it as consumer law requires. We may also, at our discretion, offer a refund or credit — for example for a prolonged, verified outage.

10. Acceptable use

You agree not to, and not to permit anyone to:

Inadvertent exposure. If you discover a defect, misconfiguration or other error that makes the answer key, or any other non-public part of the Service, reachable, you must tell us promptly at info@gestoa.com and must not access, copy, retain, use or disclose it beyond what is strictly necessary to identify and report the problem. That material stays our confidential information and stays protected under §16; it does not become public, or free to use, because it was exposed by mistake.

We may investigate and take appropriate action for any violation, including suspension or termination.

11. Your Content and the licence you grant us

11.1 Ownership

As between you and us, you own your Content. We claim no ownership of what you say in a drill or of its transcript.

11.2 Licence

You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, transcribe, process and store your Content solely to operate and provide the Service to you — to generate the counterpart's reply, score the drill, and keep your progress — and as described in the Privacy Policy. The licence ends when the Content is deleted in the ordinary course, except for backups and anything we must keep by law.

11.3 Your responsibilities

You represent that you have the rights necessary to submit your Content and that it breaks no law and infringes nobody's rights. A drill asks you to talk about a real situation at work, so take care: do not name people, and do not put another person's personal or confidential information into an answer.

11.4 Aggregated and anonymised data

We may create and use aggregated, de-identified data that does not identify you — for example how often a particular card is answered correctly — to operate, secure, analyse and improve the Service and its content. This never includes the text of your drill answers.

12. AI Feedback and the counterpart — no guarantees

Feedback is generated automatically, including by AI models. It is intended as practice guidance only. It:

The counterpart you talk to in a micro-drill is an AI model, not a person. Its replies are improvised for the exercise: they can be wrong, one-sided or unlike anything a real counterpart would say, and they are not a statement of our views or anyone else's. It is a sparring partner, and that is all.

The tactics are taught culture-neutral, and the app says so where you will see it. How a tactic lands depends on the person in front of you. You are solely responsible for what you do in a real conversation.

Our automated scoring produces no legal or similarly significant effects about you. If you think a score is wrong, write to us and a person will look at it.

13. Permitted use of Path2Negotiate outputs

Path2Negotiate is a practice tool, not an assessment instrument. Your value-held figure, per-tactic standings and session history measure your answers against our own authored answer key. They are not validated against any external standard, not calibrated across raters or organisations, and not designed to support decisions about a person.

Path2Negotiate outputs may not be used, in whole or in part, for:

You may not require anyone to use the Service, or to disclose their results, as a condition of employment, participation, assessment or advancement. Your results are yours: we do not share them with an employer, and an Account belongs to the person who trains on it.

14. Progress is one-way

This is unusual enough to state plainly. A recognition card is scored once, ever. Once you have answered a card you cannot re-answer it, reset it, or roll back your progress, and neither can we on request — the product exists to give you an honest measurement of your own judgment, and a resettable score is not a measurement. This is enforced in the database, not in the interface. Deleting your Account removes the record entirely (§18); nothing short of that reopens a solved case.

15. Data, privacy and retention

How we handle personal data is described in the Privacy Policy and the Cookies Policy. In summary, and specific to training:

16. Intellectual property

The Service — its software, the tactic library, theory, recognition cards, drills, the answer key, rubrics, scoring design, copy, design system, name and logo — is owned by us or our licensors and is protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose for as long as your access lasts, subject to these Terms. All rights not expressly granted are reserved. You may not use our name, trademarks or branding without our prior written consent.

17. Third-party services

The Service relies on third-party providers — for hosting, authentication, payments, speech-to-text and AI processing — and may link to third-party sites. They are named in the Privacy Policy. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.

18. Availability, suspension and termination

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, and we may perform maintenance or make changes. We may suspend or terminate your access if you breach these Terms, if the law requires it, or to protect the Service or other users. You may stop using the Service and delete your Account at any time. On termination your right to use the Service ends, we handle your data as described in the Privacy Policy, and §11.1, §11.3, §11.4, §12, §13, §16, §19, §20, §21, §22 and §24 survive.

19. Disclaimers

To the fullest extent permitted by law, and without limiting your non-excludable statutory rights as a Consumer, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of Feedback, and non-infringement. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law.

20. Limitation of liability

To the fullest extent permitted by law:

Nothing in these Terms limits or excludes our liability where it cannot be limited or excluded by law — including for death or personal injury caused by our negligence, for fraud, or for breach of your non-waivable rights as a Consumer. If you are a Consumer, these limits apply only to the extent the mandatory law of your country of residence permits.

21. Indemnification (business users)

If you use the Service other than as a Consumer, you agree to indemnify and hold us harmless from claims, losses and expenses, including reasonable legal fees, arising from your Content, from your use of the Service in breach of these Terms, or from your violation of law or of third-party rights. This clause does not apply to Consumers.

22. Governing law and dispute resolution

These Terms and any dispute relating to them or to the Service are governed by the laws of Spain, without regard to conflict-of-laws rules.

If you are a Consumer you keep the benefit of any mandatory provisions of the law where you live, and nothing here removes that protection. You may bring proceedings where you live or in Spain, as applicable law allows, and you may also use any alternative dispute resolution body competent for consumer disputes in your country.

23. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date and give reasonable notice by email or in the app. Changes are not retroactive. If you continue using the Service after they take effect, you accept the updated Terms; if you do not agree, stop using the Service.
